NICOLE NIXON WEBSITE TEMPLATE TERMS OF SERVICE

1. AGREEMENT TO TERMS

By clicking “Buy Now,” entering your payment information, or otherwise completing your purchase of any Nicole Nixon Website Template (the “Product”), you (“Customer”) are entering a legally binding agreement with Nicole Nixon LLC (“Company”). All sales are final. Customer agrees to all terms outlined in this Agreement (“Agreement”).

Purchasing the Product means you will be charged the full amount of the purchase price selected at checkout—either:

$197 for the Single-Page Website Template, or

$297 for the 3-Page Website Template

2. INTRODUCTION

The Company provides branding, design, and creative business education. The Product consists of a digital website template (or templates) created for hairstylists, beauty pros, and creative service providers who want to elevate their online presence.

The Product is a digital, downloadable website template delivered via Showit and/or Canva (depending on the template purchased).
No physical items will be shipped.

3. TERM OF ACCESS

Customer will have ongoing access to the purchased template for as long as the Product is offered. The Company reserves the right to retire, update, or discontinue templates at any time.
Sections 8–11 survive termination of this Agreement.

4. DISCLAIMERS

No Professional Relationship
Company is not acting as Customer’s employee, designer, developer, coach, strategist, consultant, therapist, or financial advisor.

Educational/DIY Product
Customer understands the Product is for general educational and informational purposes only. Implementation is the responsibility of the Customer. Company cannot guarantee results, outcomes, increased income, client bookings, or business success.

No Services Included
This Product does not include:

Done-for-you website design

Custom branding

Custom website development

Copywriting

SEO services

Tech setup

1:1 support or coaching

Showit subscription fees

Any revisions or customizations

Customer Responsibility
Customer acknowledges they are solely responsible for their choices, results, income, and outcomes. Any business decisions made after using the Product are entirely the Customer’s responsibility.

5. IMAGE USE DISCLAIMER

Some visual content included inside the template—such as stock photos, mood boards, or placeholder images—may come from publicly available platforms like Pinterest or other online sources. These are used solely for demonstration and layout purposes. Company does not claim ownership of these images.

Customer is responsible for replacing all demo images with legally licensed imagery before publishing their site.

6. WHAT’S INCLUDED

Depending on the Product purchased, Customer will receive:

Single-Page Template ($197): 1 Showit website template page

3-Page Template ($297): 3 Showit website template pages

Both products include:

Import/share key(s)

Basic instructions for installation

Placeholder copy and design structure

Editable sections and layouts

Company may update or substitute elements of the Product if needed.

7. CUSTOMER RESPONSIBILITIES

Customer acknowledges:

This is a DIY template that requires customization to function as a live website.

Company cannot guarantee Customer’s results.

Customer is 100% responsible for implementing the template, replacing images, editing copy, connecting integrations, and ensuring legal compliance (privacy policy, disclosures, etc.).

8. PAYMENT & FEES

By completing checkout, Customer agrees to pay the full purchase amount selected.

If a payment plan is offered and selected, Customer is responsible for completing all scheduled payments, regardless of participation or usage.

Failed payments must be remedied within 5 business days (updated card, manual payment, etc.). Failure to resolve payment issues may result in revoked access.

Chargebacks are prohibited. Any attempted chargeback will be considered a breach of this Agreement and may be sent to collections and reported to credit bureaus.

9. REFUND POLICY

All sales are final.
Due to the digital nature of the Product, no refunds, no cancellations, and no exchanges are permitted for any reason, including but not limited to:

Not knowing how to use Showit or Canva

Not having the required software

Changing your mind

Failure to implement the template

Dissatisfaction with design after purchase

10. NON-DISCLOSURE & CONFIDENTIALITY

Customer agrees that all Product files, instructions, processes, structure, design organization, and backend content are proprietary and confidential to the Company.

Customer may not share access to the Product with anyone else.

Company may share customer testimonials or general feedback in marketing unless Customer specifically requests otherwise.

11. INTELLECTUAL PROPERTY & LICENSE

All templates and materials are the sole intellectual property of the Company.

Customer receives a limited, non-transferable, single-use license to use the template for one website for their own business only.

Customer may NOT:

Share, sell, gift, or distribute the template

Transfer the template to clients

Claim the design as their own

Use the template for multiple businesses

Resell, replicate, or recreate derivative designs based on the template

Use the template as a designer to create websites for clients

Designers must purchase a separate commercial or multi-use license (if offered).

Unauthorized distribution of digital products may result in revoked access, legal action, and damages.

12. INDEMNIFICATION & LIMITATION OF LIABILITY

Customer agrees to indemnify and hold Company harmless from any claims, damages, losses, or legal actions arising from:

Website errors or issues

Publishing unlicensed images

Business decisions

Technical failures

Loss of income

Third-party platform outages (Showit, Canva, Shopify, ThriveCart, etc.)

Company is not liable for Customer’s business performance, website performance, or technical ability.

13. MISCELLANEOUS

Amendments: Company may update these Terms at any time.

Severability: If any part is unenforceable, the remainder still applies.

Entire Agreement: This Agreement supersedes all prior discussions or communications.

Governing Law: California law governs this Agreement.

Arbitration: Any disputes will be resolved through binding arbitration.

14. EXECUTION

By completing your purchase and checking the box agreeing to these Terms & Conditions, Customer agrees to all terms of this Agreement.
